  • Identity theft — The Texas Penal Code section on fraud prohibits the unauthorized use or possession of someone else’s identifying information. People who are convicted of an identity theft crime could be punished by several years in prison depending on how many items were used illegally and if the information was exploited for financial gain. When the charge covers five items or fewer, the crime is classified as a state jail felony where someone could be incarcerated for up to 180 days. Cases involving 50 or more items trigger first-degree felony charges where the minimum sentence is five years. My firm takes on authorities in situations where accusations of identity theft aren’t warranted or the defendant has been overcharged.
  • Hacking — Accessing someone else’s computer without permission is illegal. The specific penalty depends on the defendant’s intent for doing so. Stricter penalties exist when someone is found to have hacked in order to solicit a minor or break into a voting machine.
  • Possession of unlawful content — Whether someone is accused of possessing illegal sexually explicit images, unauthorized versions of copyrighted material or proprietary business-related content, my firm sifts through the pertinent information to identify all available defenses. In some instances, photos or documents can be downloaded without the user’s awareness. Other times, a person might reasonably believe that he or she is allowed to possess the material in question.
