Types and penalties
There are varying degrees of felony burglary; 1st, 2nd, 3rd and 4th. 3rd and 4th degree involve businesses or other buildings that are not a home and are considered a “state jail felony.” 2nd degree burglary, which is a 2nd degree felony, involves the burglary of a habitation, while 1st degree is also the burglary of a habitation, but it must also involve the attempt or intent to commit another aggravating offense.
